1. ACCEPTANCE OF TERMS

By accessing or using the Vyuhxti Threat Intelligence Platform ("Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our End User License Agreement (EULA). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. DESCRIPTION OF SERVICE

2.1 Platform Overview. Vyuhxti is a cyber threat intelligence platform that provides:

Vulnerability tracking and analysis (CVE monitoring)
Threat actor profiling and attribution
Indicators of Compromise (IOC) tracking
Relevance-based scoring for organizational risk assessment
Integration with third-party security tools
AI-powered threat analysis and reporting
Known Exploited Vulnerabilities (KEV) monitoring

2.2 Service Availability. We strive to maintain 99.5% service availability. However, the Service may be temporarily unavailable due to:

Scheduled maintenance (with advance notice when possible)
Emergency maintenance or security updates
Factors beyond our reasonable control

2.3 Service Modifications. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. USER ACCOUNTS

3.1 Account Registration. To access the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly update any changes to your account information
Be at least 18 years old or the age of majority in your jurisdiction

3.2 Account Security. You are responsible for:

All activities that occur under your account
Maintaining the confidentiality of your password
Notifying us immediately of any unauthorized access
Using strong, unique passwords and enabling multi-factor authentication when available

3.3 Account Types. The Service offers different account types with varying access levels:

Individual: Single user access
Team: Multi-user access with role-based permissions
Organization: Enterprise-level access with administrative controls
MSSP: Managed service provider multi-tenant access

4. ACCEPTABLE USE POLICY

4.1 Permitted Uses. You may use the Service for:

Monitoring vulnerabilities affecting your organization
Assessing threat actor relevance to your security posture
Generating threat intelligence reports for internal use
Integrating threat data with your security tools
Fulfilling compliance and risk management requirements

4.2 Prohibited Uses. You shall NOT use the Service to:

(a) Malicious Activities: - Conduct cyber attacks or unauthorized access attempts - Develop malware, exploit kits, or attack tools - Plan or execute denial-of-service attacks - Engage in any form of hacking or unauthorized intrusion

(b) Illegal Activities: - Violate any applicable laws or regulations - Infringe intellectual property rights - Engage in fraud, deception, or misrepresentation - Facilitate criminal activity

(c) Abuse of Service: - Attempt to circumvent access controls or security measures - Reverse engineer, decompile, or disassemble the Service - Interfere with or disrupt the Service or servers - Use automated systems to excessively access the Service (unless via approved APIs) - Share account credentials with unauthorized parties

(d) Data Misuse: - Resell raw threat intelligence data as a standalone product - Misrepresent the source or accuracy of threat data - Use the Service for competitive intelligence against Vyuhxti - Harvest or collect user data from the Service

4.3 Enforcement. We reserve the right to investigate and take appropriate action against violations, including:

Warning or suspension of accounts
Termination of accounts
Legal action where appropriate
Cooperation with law enforcement

5. THREAT INTELLIGENCE DATA

5.1 Data Sources. The Service aggregates threat intelligence from multiple sources:

5.2 Data Accuracy. While we strive for accuracy:

Threat intelligence data may contain errors or omissions
Data is provided "as is" without guarantees
Third-party data sources may change or become unavailable
Real-time threat landscape changes may not be immediately reflected

5.3 Data Currency. Threat intelligence data is updated regularly, but:

New vulnerabilities may emerge between updates
Threat actor activities evolve continuously
Historical data may not reflect current conditions
Attribution confidence levels vary

5.4 User Responsibility. You are responsible for:

Independently verifying critical security decisions
Implementing appropriate security controls
Maintaining comprehensive security programs
Not solely relying on the Service for security

6. INTELLECTUAL PROPERTY

6.1 Our Property. The Service, including its design, features, content, and documentation, is owned by Vyuhnet Technologies Private Limited and protected by intellectual property laws. You receive only a limited license to use the Service as specified in these Terms.

6.2 Trademarks. "Vyuhxti," the Vyuhxti logo, and related marks are trademarks of Vyuhnet Technologies. You may not use these marks without prior written permission.

6.3 Third-Party Content. The Service includes content from third-party sources, which remain the property of their respective owners subject to their applicable licenses.

6.4 User Content. You retain ownership of any content you submit to the Service (e.g., custom profiles, uploaded data). By submitting content, you grant us a license to use it for providing and improving the Service.

7. PRIVACY AND DATA PROTECTION

7.1 Privacy Policy. Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

7.2 Data Processing. We process data in accordance with applicable data protection laws, including:

GDPR (for EU users)
CCPA (for California users)
IT Act, 2000 (for Indian users)

7.3 Security Measures. We implement appropriate technical and organizational measures to protect your data, including encryption, access controls, and security monitoring.

8. SUBSCRIPTION AND PAYMENT

8.1 Subscription Plans. Access to the Service requires a valid subscription. Plan details, pricing, and features are described on our website.

8.2 Payment Terms.

Fees are due in advance for the subscription period
All fees are non-refundable except as required by law
We may change pricing with 30 days' notice
Late payments may result in service suspension

8.3 Free Trials. We may offer free trials or demo accounts subject to:

Limited duration and features
No guarantee of continued availability
Conversion to paid subscription for continued access

8.4 Cancellation. You may cancel your subscription at any time:

Access continues until the end of the current billing period
No refunds for unused portions of the subscription
You may export your data before cancellation

9. DISCLAIMER OF WARRANTIES

9.1 "AS IS" Basis. THE SERVICE AND ALL THREAT INTELLIGENCE DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

9.2 No Security Guarantees. WE DO NOT WARRANT THAT:

The Service will detect all threats or vulnerabilities
Threat intelligence data is complete or accurate
Using the Service will prevent security incidents
The Service will meet all your security requirements

9.3 Disclaimer. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY
UNINTERRUPTED SERVICE

10. LIMITATION OF LIABILITY

10.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, or consequential damages
Loss of profits, revenue, data, or business opportunities
Security breaches or cyber attacks on your systems
Damages from reliance on threat intelligence data
Damages from missing, incomplete, or inaccurate data
Third-party claims against you

10.2 Liability Cap. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10.3 Essential Basis. These limitations apply regardless of the form of action and reflect an essential element of the bargain between us.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Vyuhnet Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Security incidents on your systems
Your redistribution of threat intelligence data

12. TERM AND TERMINATION

12.1 Term. These Terms are effective upon your acceptance and continue until terminated.

12.2 Termination by You. You may terminate by:

Canceling your subscription
Ceasing use of the Service
Deleting your account

12.3 Termination by Us. We may terminate or suspend your access:

Immediately for violations of these Terms
With 30 days' notice for convenience
Immediately if required by law

12.4 Effect of Termination.

Your right to use the Service ends immediately
We may delete your account data after a reasonable period
Provisions that should survive termination will continue to apply

13. CHANGES TO TERMS

13.1 Modifications. We may modify these Terms at any time by posting updated Terms on our website.

13.2 Notice. We will provide notice of material changes via:

Email to registered users
In-app notification
Prominent posting on our website

13.3 Acceptance. Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service.

14. GENERAL PROVISIONS

14.1 Governing Law. These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution. Disputes shall be resolved through binding arbitration in Bangalore, India, under the Arbitration and Conciliation Act, 1996.

14.3 Severability. If any provision is found unenforceable, the remaining provisions continue in effect.

14.4 Waiver. Our failure to enforce any provision does not waive our right to enforce it later.

14.5 Entire Agreement. These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between us.

14.6 Assignment. You may not assign these Terms without our consent. We may assign these Terms freely.

14.7 Force Majeure. We are not liable for failures due to circumstances beyond our reasonable control.
